Here are the terms of service for my commissions. Be sure to read through them and ask questions before ordering to ensure you understand them thoroughly.
01: GENERAL TERMS
-
The term "I" will always be referring to me, the artist, and "you" will always be referring to the commissioner, or the person who is paying for the art.
-
I have the right to refuse a commission for any reason without providing an explanation.
-
I have the right to refuse to work with someone for any reason.
-
I have the right to cancel a commission and refund the money to the commissioner for any reason.
-
I have the right to blacklist a commissioner for any reason.
-
I have the right to change the price of a commission based on the complexity of the work or based on demand.
02: PAYMENT
-
Payment can either be 100% upfront, or 50% before the sketch is provided and 50% after sketch approval.
-
Do not send a payment to me without warning and/or prior to any kind of discussion between the two of us occurring. This could result in an unfortunate situation where I assume it is a donation.
-
The only currency accepted is USD (United States Dollar). To convert your currency, please visit xe.com for accurate currency conversions, and be sure to send the correct amount.
-
Payments can only be made through PayPal and CashApp.
03: CANCELLATIONS AND REFUNDS
-
After the sketch has been approved, you, the commissioner, you will no longer be eligible for a refund.
-
Cancelling the commission after sketch approval will not make the commissioner eligible for a refund.
-
You are eligible for a refund if you have not received your commission after three months UNLESS otherwise has been stated in a discussion between I, the artist, and you, the commissioner.
-
Chargebacks are not permitted whatsoever, regardless of whether you may or may not be entitled to a refund. I will transfer the money back to you myself.
04: COMMISSIONING & PROCESS
-
Descriptions are helpful but I will not accept commissions based on descriptions only. The commissioner must provide clear references.
-
You are allowed to change your sketch as many times as necessary without a fee. You will be charged a small fee for requesting a change anytime after the sketch approval.
-
If a mistake or misunderstanding came from my end, you will not have to pay a fee for a change to the artwork.
-
The commissioner will be provided with a sketch first, and must approve it before anymore work is done.
-
Progress reports will be sent every four weeks or when I, the artist, deem it fit.
05: COPYRIGHT AND COM. USAGE
-
I, the artist, hold all rights to the commissioned artwork, not the commissioner. Therefore, I am allowed to share the artwork where I want, publish the artwork, promote myself with it, and all other rights which are granded to me underneath the copyright law.
-
You, the commissioner, are allowed to share the artwork where you deem it fit and for other personal usage.
-
Using the commission for commercial usage is not permitted.
-
Taking credit for the produced illustration is not allowed.
-
I will not profit off of your commission unless you have broken the Terms of Service or we have come an agreement.
06: BLACKLIST
-
I have the right to blacklist anyone from my commissions.
-
Chargebacks at any time will result in the commissioner becoming blacklisted and no longer eligible for a refund, as I will repeal the chargeback. I will also share your name with other artists to encourage them to avoid making transactions with you.
-
Hate speech, racism, sexism, or any kind of discrimination towards anyone is not tolerated and will lead to the commissioner being blacklisted.
-
Removal of the watermark in my artwork will result in the commissioner being blacklisted, and I will gain the right to profit off of your commission(s). I will also share your name with other artists to encourage them to avoid making transactions with you.
-
Altering the commission in any way that I do not deem valid can result in the commissioner being blacklisted.
-
Commercial usage of the commission can result in the commissioner being blacklisted, and will make me, the artist, entitled to all profits you have made with any merchandise that includes my artwork. This includes if the commission was traced over or used as a base.
-
To be blacklisted means that you will no longer be able to commission me under any circumstances unless I have stated otherwise. If you are blacklisted during the artwork's proccess, you will not receive a refund.
